These Terms and Conditions of Use govern your access to and use of the Priority Performance Projects (PPP), BuildRSA, BOP, BLAK Magazine, African Genius Awards (AGA), OWL and OWL Mobile Application websites and platforms. By visiting or using any of these sites, you confirm that you have read, understood and agreed to be bound by these Terms together with our Privacy Policy. If you do not accept these Terms, you should not continue to use the website or platform.

PPP and its subsidiaries, brands and affiliates exist to foster unity, innovation and collaboration through meaningful digital engagement. The platforms are intended as a space for constructive participation and contribution and all activity undertaken on them should reflect and support this underlying mission.

The platform may only be used by individuals who are at least thirteen years of age. By using PPP, you represent that you meet this requirement and that you are legally capable of entering into a binding agreement under the laws of your jurisdiction. In cases where local law requires the consent of a parent or guardian for minors, such consent must be secured before use of the platform and access by minors is governed by our Child Protection Policy.

Users of PPP’s sites are expected to act lawfully and responsibly and you unequivocally agree that you will not post or distribute content that constitutes hate speech, incites violence, exploits vulnerable groups or spreads disinformation that can be harmful. You must not harass, abuse or threaten other users, nor may you upload or share material that is illegal, harmful or sexually explicit. Impersonation of others, misrepresentation of your identity or affiliation, and the use of the platform for criminal or fraudulent purposes, including phishing, spamming or distributing malicious code are strictly prohibited. PPP reserves the right to cooperate fully with law enforcement authorities and regulators should unlawful conduct be detected and to institute claims for damages in any relevant jurisdiction.

All content created and shared by users remains their property. However, by posting content on PPP, you grant PPP a worldwide, royalty-free, non-exclusive and transferable licence to use, display, reproduce adapt and distribute that content within the platform and for limited purposes consistent with the mission of PPP. The platform’s branding, trademarks, design and underlying software remain the sole and exclusive property of PPP and may not be copied, reproduced, reverse-engineered or exploited without express written consent of PPP.

PPP reserves the right to moderate and, where necessary, remove content or restrict or suspend user accounts if conduct is found to be in breach of these Terms, contrary to applicable law, or inconsistent with the spirit and values of the platform. Decisions of this nature are exclusively at PPP’s discretion.

PPP is committed to protecting your privacy and handling your personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA), and where applicable, international standards such as the General Data Protection Regulation (GDPR). Our Privacy Policy sets out what data we collect, the legal basis on which it is processed, how long it is retained and the rights you have in respect of that data. We take care to ensure that any transfer of data across borders occurs only where adequate protections are in place, but depending on where you access the sites from and or in which jurisdiction you are, data may inadvertently be transferred across border(s), as the data centres used for the platforms may be based in different territories.

PPP takes appropriate technical and organisational measures to safeguard personal information and to secure the platform against unauthorised access, misuse or cyberattacks. You acknowledge, however, that no system is completely immune from risk and that you use the platform at your own discretion and wholly accept the risk involved with accessing our sites and applications.

PPP may suspend or terminate your access to the platform without notice where you have breached any of these Terms, misused the service, acted in a discriminatory manner or acted in a manner inconsistent with the mission of PPP. You may also request termination of your account, together with the deletion of your data, in accordance with our Privacy Policy.

The platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, PPP disclaims all warranties, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose and non-infringement. PPP shall not be liable for indirect, incidental or consequential damages, for loss of data, profits or goodwill, or for interruptions to service or unauthorised access to accounts. Users remain responsible for ensuring that their use of the platform complies with the laws of their local jurisdiction and that their login credentials and internet connection points are kept safe are secure.

PPP may amend these Terms from time to time. Where significant changes are made, reasonable steps will be taken to notify users by way of email and or by way of notification on the platform. By continuing to use the platform after such changes have been published, you agree to be bound by the revised Terms.

These Terms are governed by and will be interpreted in accordance with the laws of the Republic of South Africa. Any disputes arising in relation to them shall fall under the exclusive jurisdiction of the South African courts.
